| The elements of public law about sources of law and about of the incorporation of international law sources into the domestic legal order and the elements of international law about international organizations that are necessary to understand how European Union legistation is connected to Italian legislation are taught during the course and are included in the reference materials. |

| The course covers the main legal characteristics of the European Union, with particular attention to the “Community model”, i.e. to advanced methods of legal integration that developed within the European Community, now merged into the Union. The program opens with the historical origin of the Communities and the Union, then it highlights the peculiarities of the Community – and then of the Union – legal phenomenon, in contrast with other international organizations, on the one hand, and the federalist processes, on the other. We are, therefore, gradually introduced the EU’s institutional framework and the main legal mechanisms that govern its functioning, the characteristics of primary law (treaties and principles), and derivative (acts of the institutions) of the Union, the primacy of the law of the Union over the national law of the Member States and in general the relationship between the two types of legal sources. In conclusion, it outlines the main lines of action for the Union support in the field of vocational training, education and youth. |

| LEARNING OUTCOMES: The course is aimed at providing students with the necessary theoretical basis to understand the origins, nature and juridical effects of the sources of European Union law. Students will, thus, be able to autonomously follow the continuous developments of EU legslation in the fields of interest. KNOWLEDGE AND UNDERSTANDING: In line with the educational objectives of the Study Program stated in the SUA-CdS, the training activity aims to provide the student with the following knowledge and skills: the course will bring students to the knowledge and understanding of the nature of the sources of law of the European Union that, since the late ’50s, very effectively, have their effects within the legal systems of the Member States. APPLYING KNOWLEDGE AND UNDERSTANDING: The aim is to develop the ability to apply knowledge and understanding to the regulations and forms of cooperation that specifically concern the sector of education and vocational training, with particular reference, for example, to the characteristics of support programs (for example, mobility of teachers and learners) and to the nature of the “Dublin descriptors” developed in the framework of the European qualifications framework for lifelong learning, but also to the “indirect” fallout of policies that are carried out on the basis other legal bases, in particular those relating to the free movement of workers (with consequent recognition of qualifications obtained in another State of the Union), in the field of education. MAKING JUDGEMENTS: Students will be able to develop autonomous judgment on the advantages that have been achieved and on the opportunities and difficulties involved in Italy’s participation in the European Union, as well as on the margins for improvement in practical application, at all levels, of the “ascending” and “descending” phases with respect to the adoption of Union acts. COMMUNICATION SKILLS: The development of communication skills regarding the content and effectiveness of EU policies in areas relevant to education and vocational training is stimulated through comments on legislation and jurisprudence. LEARNING SKILLS: The learning skills are enhanced also in view of research activities: topics are carried out in a way that stimulates personal reflection for solving problematic knots, comparing normative sources with European jurisprudence. |
| Methods and criteria for verifying the learning: |

| The exam takes place orally at the end of the entire teaching cycle. It consists in verifying the knowledge acquired during the course, which refer to the contents of the adopted text, as well as to some particularly important documents, which are available on the teaching website and commented in class. The learning is verified with the examination through questions that deal with the program of the course and that allow the student to demonstrate the acquisition of critical, analytical and systematic method in front of the normative data. Specifically, the student is asked to demonstrate knowledge of the fundamental notions of the subject and to show the ability to adequately argue, comparing different positions. The final evaluation is expressed through a numerical grade that summarises the level of detail and critical ability achieved by the student. The exam assesses the student’s overall preparation, the ability to combine knowledge about each part of the syllabus, the coherence of argumentation, the analytical ability, and the autonomy of judgment. In addition, the student’s command of language and clarity of presentation are also assessed, in adherence with the Dublin descriptors (1. knowledge and understanding; 2. applying knowledge and experience; 3. making judgments; 4. learning skills; 5: communication skills). The final grade is based 70% on the student’s depth of knowledge and 30% on the student’s ability for expression and independent critical thinking. The exam is evaluated according to the following criteria: – Failed: significant deficiencies and inaccuracies in the knowledge and the understanding of the subject matter; poor analytical and synthesizing skills, recurrent generalizations, limited critical and judgmental skills; the arguments are exposed inconsistently and with inappropriate language. – 18-20: Knowledge and understanding of topics barely adequate, with occasional generalizations and imperfections possible; sufficient capacity for analysis synthesis and autonomy of judgment, the arguments are frequently exposed in an incoherent manner and with inappropriate language. – 21-23: Fair knowledge and understanding of the subject; proper analysis and synthesis skills with coherent, logical argumentation, but with language that is often inappropriate. – 24-26: Moderate knowledge and understanding of the subjects; good analytical and synthesis skills with arguments expressed rigorously but with language that is not always appropriate. – 27-29: Comprehensive knowledge and understanding of the subjects; remarkable analytical and synthesis skills. Good autonomy of judgment. Topics expounded rigorously and with appropriate technical language. 30-30L: Excellent level of in-depth knowledge and understanding of the subjects. Excellent skills in analysis, synthesis, and independent judgment. Arguments are expressed in an original way and with appropriate technical language. |
